TERMS AND CONDITIONS OF SALE
1. DEFINITIONS
1.1 "Buyer" means the individual or organization that buys or agrees to buy the Goods from Justdining.com.
1.2 "Contract" means the contract between Justdining.com and the Buyer for the sale and purchase of Goods incorporating these Terms and Conditions.
1.3 "Goods" means the goods and/or services that the Buyer agrees to buy from Justdining.com.
1.4 "Justdining.com" means the Just Dining, Inc., and having its registered retail location at 3131 SW College Rd. (suite #207) Ocala, FL 34474
1.5 "Terms and Conditions" means the terms and conditions of sale set out in this document.
1.6 "Website" means this website (or any replacement website substituted therefore by Justdining.com).

2. Application of Terms
2.1 These Website Terms and Conditions (the "Terms") govern the relationship between you and Just Dining, Inc. with regard to your use of Justdining.com’s site.
2.2 Submission by Buyer of an order for Goods shall be deemed conclusive evidence of Buyer’s acceptance of these Terms and Conditions.

3. ORDERING
3.1 All orders for Goods shall be deemed to be an offer by the Buyer to purchase Goods pursuant to these Terms and Conditions and are subject to acceptance by Justdining.com. Justdining.com may choose not to accept an order for any reason.
3.2 Justdining.com will send an electronic acknowledgement to the Buyer within 48 hours upon successful submission of the electronic order.
3.3  Buyer acknowledges that Goods are manufactured specifically for Buyer and are not subject to cancellation, except within first 72 hours after order is placed.
3.4 Justdining.com will not entertain any cancellations after 72 hours
3.5 Buyer acknowledges that goods are manufactured specifically for buyer and are not subject to return, refund, or exchange.
3.6 All goods purchased on the Website are non-returnable.
3.7 Buyer acknowledges Justdining.com cannot collect applicable sales tax for States other than Florida. 
3.8 Buyer assumes responsibility for payment all sales and use tax due in their State, County, or Province and shall not hold Justdining.com responsible or liable for any additional taxes due.

4.  PRICE AND PAYMENT
4.1 The Price of the Goods shall be that stipulated on Justdining.com’s Website.
4.2 The total purchase price, delivery charges, and applicable sales tax will be displayed as total amount payable prior to confirming the order.
4.3 Justdining.com will not accept partial payments, nor abate taxes for Florida Residents as per Florida Tax Law.
4.4 After the order is received Justdining.com shall confirm by email the details, description and price for the Goods. 
4.5 Payment of the total purchase and applicable delivery charges must be made in full before manufacturing of the Goods.
4.6 Payment is to be made by any of the payment methods accepted by Justdining.com, details of which are noted during the checkout process.
4.7 All orders are subject to authorization and charging of payment by the relevant card issuer prior to dispatch of the Goods.
4.8 During online payment, where sensitive information such as credit card details is required, the transmission of information is encrypted and protected using Secure Sockets Layer (SSL).

5. RIGHTS OF JUSTDINING.COM
5.1 Justdining.com reserves the right to adjust the price and specification of any item on the Website at its discretion.  Any purchases already submitted and approved by Justdining.com will not be affected by price changes. 
5.2 Justdining.com reserves the right to withdraw any Goods from the Website at any time.
5.3 Justdining.com shall not be liable to anyone for withdrawing any Goods from the Website or for refusing to accept an order.

6. AGE RESTRICTIONS
All Buyers must be at least 18 years of age to purchase from Justdining.com

7. WARRANTY
7.1 Justdining.com cannot describe every detail of the Goods in the Justdining.com and each description is therefore abbreviated and is correct at the time of its input. Justdining.com reserves the right to alter the specification/description of Goods on the Website without notice. 
7.2 Manufacturers warrant to the original consumer that their products will be free of defects in specified material and workmanship for the period of the warranty.  Warranty information is provided along with the product by each individual manufacturer.
7.3 Upon request, Justdining.com will provide Buyer with warranty information from the original manufacturer.
7.3 Justdining.com does not assume, nor authorize any to assume for it, any other obligations or liability in connection with products sold. 
7.4 All warranty claims for purchases online will be made through Justdining.com. Buyer is responsible for all receipts and proof of sale.

8. SHIPPING
8.1 All goods will normally ship within the specified time frame from the manufacturer.
8.2 Justdining.com shall provide, upon request from the Buyer, any information on the status of an order in production. Notwithstanding the foregoing, time of delivery shall not be of the essence and Justdining.com shall not be liable for any losses, costs, damages or expenses incurred by the Buyer or any third party arising directly or indirectly out of any failure to meet any estimated delivery date.
8.4 Delivery of the Goods shall be made to the Buyer’s address specified in the order and the Buyer shall make all arrangements necessary to take delivery of the Goods.
8.5 Ownership and risk in the Goods shall pass to the Buyer upon receipt of the Goods.
8.6 All applicable delivery charges are non-refundable once a delivery attempt is made.
8.7 Changes to delivery methods or location CANNOT be made after the 72 hour cancellation period.

9. CANCELLATION AND RETURNS
9.1 The Buyer shall inspect the Goods immediately upon receipt and shall notify Justdining.com within 5 days of delivery if the Goods are damaged or do not comply with any of the Contract. If the Buyer fails to do so the Buyer shall be deemed to have accepted the Goods.
9.2 Where a claim of defect or damage is made the Buyer shall provide Justdining.com with evidence (digital photos) of the damage or defect through electronic communication (email) or through the claims form.
9.3 The validity of all claims of damages will be determined, upon evidence, by Justdining.com and the original Manufacturer.  
9.4 Where returned Goods are found to be damaged due to the Buyer’s fault the Buyer will be liable for the cost of remedying such damage.

10. THIRD PARTY SITES
10.1 Buyer acknowledges that the web site may contain links to websites operated by third parties ("Third Party Sites"). Buyer further acknowledge that these links are for Buyer convenience only and Justdining.com does not endorse, nor purport to control, monitor or verify the contents of the Third Party Sites. Justdining.com shall not be liable for the contents of the Third Party Sites or for any loss, damage or injury sustained by Buyer arising out of use by Buyer of a Third Party Site.

11. LIMITATION OF LIABILITY
In the event of any breach of these Terms and Conditions by Justdining.com the remedies of the Buyer shall be limited to damages which shall in no circumstances exceed the Price of the Goods and Justdining.com shall under no circumstances be liable for any indirect, incidental or consequential loss or damage whatever suffered by the Buyer.

12. WAIVER
No waiver or delay by Justdining.com (whether express or implied) in enforcing any of its rights under this Contract shall prejudice its rights to do so in the future.
13. FORCE MAJEURE
Justdining.com shall not be liable for any delay or failure to perform any of its obligations if the delay or failure results from events or circumstances outside its reasonable control, including but not limited to acts of God, strikes, lock outs, accidents, war, fire, breakdown of plant or machinery or shortage or unavailability of raw materials from a natural source of supply, and Justdining.com shall be entitled to a reasonable extension of its obligations. Justdining.com shall endeavor to notify the Buyer as soon as possible should any such events or circumstances occur.

14. CHANGES TO TERMS AND CONDITIONS
Justdining.com shall be entitled to change these Terms and Conditions at any time.

15. OWNERSHIP AND RISK OF LOSS
Ownership of the goods delivered shall pass to the Buyer upon receipt of payment by Justdining.com. The risk of loss or damage to the goods shall pass to the Buyer upon delivery.

16. SEVERABILITY
If any term or provision of these Terms and Conditions is held invalid, illegal or unenforceable for any reason by any court of competent jurisdiction such provision shall be severed and the remainder of the provisions hereof shall continue in full force and effect as if these Terms and Conditions had been agreed with the invalid illegal or unenforceable provision eliminated.
The invalidity of any provision or obligation hereunder or the contravention thereby of any law shall not relieve the Buyer from its obligations under these Terms and Conditions.

17. GOVERNING LAW AND JURISDICTION
These Terms and Conditions shall be governed by and construed in accordance with the laws of Florida and the parties hereby submit to the exclusive jurisdiction of the Courts of the State of Florida.
